NOTICE: IT SHALL BE UNLAWFUL FOR ANY PERSON TO CONDUCT A YARD SALE OR OTHER SALE OF GOODS, WARES OR MERCHANDISE WITHIN THE CITY OR WITHIN THE POLICE JURISDICTION THERE OR EXCEPT AS SUCH SHALL COMPLY WITH ALL OF THE FOLLOWING CONDITIONS AND PROVISIONS:
- The goods, wares or merchandise shall be drawn from the personal household or constitute items of personal use of a resident of the dwelling where the sale is conducted and shall have been owned by the person for more than one year prior to the date of the sale.
- There shall be no more than two (2) sales at any residence or location within any one calendar year with each permitted sale to extend not more than two (2) days of consecutive duration.
- There shall be no pooling of possessions from other households or by persons all of whom are not permanent residents at the location where the sale is conducted, unless each person participating has been issued a permit.
- THERE SHALL BE NO SIGNS OR ADVERTISEMENTS OF THE SALE POSTED ON THE PUBLIC RIGHT OF WAY OR ON THE PRIVATE PROPERTY OF OTHERS. (Example: Utility poles, city traffic control signs and other public fixture)
- A permit for each sale shall be obtained from the city clerk prior to the holding of the sale, upon application forms supplied by the clerk, which forms shall require pertinent data as to the dates and nature of the sale items to be sold, the owner or owners of the merchandise, and the person or persons responsible for complying herewith. No permit shall be issued until and unless all provisions of this section shall have been complied with in every respect. There will be no charge for the permit issued under this section (Ord. VIOLATION OF THIS ORDINANCE CARRIES UP TO A $500.00 FINE.
